“Fundraiser(s)” refers to individuals or entities creating campaigns to raise money via the Platform.
3. Eligibility
To use the Platform, you must be at least 18 years of age, or the age of majority in your jurisdiction, and capable of entering into a legally binding agreement. If you are under 18, you must have the consent of a parent or legal guardian to use the Platform.
4. Account Creation and Security

Truthful Information: You must provide truthful and accurate information when creating or supporting a campaign. Misleading, false, or deceptive campaigns will be removed, and violators may be banned from the Platform.

No Fraudulent Activity: Users are prohibited from engaging in fraudulent activities, including but not limited to misusing funds, falsifying information, or impersonating others. Violators will face account suspension and may be subject to legal action.

Campaign Transparency: Fundraisers must be transparent about how the funds will be used. You agree to update your campaign regularly and provide detailed reports on the use of funds.
7. Donations, Fees, and Payment Processing

Donation Processing: All donations made through the Platform are processed by third-party payment processors. The Foundation is not responsible for the actions of these payment processors.

Fees: The Foundation charges a platform fee for using our fundraising tools. This fee will be clearly stated during the campaign creation process. Additionally, payment processors may charge fees for handling donations.

Tax and Legal Compliance: You are responsible for complying with tax regulations in your jurisdiction. The Foundation does not provide tax advice, and you are encouraged to consult a tax professional regarding any donations received or made through the Platform.
8. Intellectual Property

Ownership: All content, trademarks, logos, and other intellectual property associated with the Platform are owned by Give and Hope Foundation or its licensors. You may not use, reproduce, or distribute any of this content without permission.

User Content: You retain ownership of the content you upload to the Platform (e.g., campaign descriptions, images, and videos). However, by submitting content to the Platform, you grant Give and Hope Foundation a worldwide, non-exclusive, royalty-free license to use, display, distribute, and promote such content in connection with the Platform.

Suspension by Foundation: We reserve the right to suspend or terminate your access to the Platform if you violate these Terms, engage in fraudulent activity, or act in a manner that harms the Foundation’s reputation or operations.
11. Limitation of Liability
To the fullest extent permitted by law, Give and Hope Foundation shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Platform, including but not limited to damages related to donations, content, or third-party links. The Foundation does not guarantee the success of any fundraising campaign or the accuracy of any information provided.
12. Indemnity
You agree to indemnify and hold harmless Give and Hope Foundation, its affiliates, officers, employees, and agents from any claims, losses, liabilities, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or any third-party claims related to your content or campaign.
13. Governing Law and Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which Give and Hope Foundation is incorporated, without regard to its conflict of law principles.
